Can Justices Invoke Their Own Incentives?
My latest FindLaw column attempts to explain the issue and the result in last week's Supreme Court decision in Danforth v. Minnesota. The case holds that state courts are free, on state habeas, to give retroactive effect to U.S. Supreme Court rulings that, according to the Supreme Court, they are not required to treat as retroactive. This is a very technical and confusing area of law, and so writing about it for a lay readership may be a fool's errand, but if so, I'm just the fool to do it!

Lane, which generally forbids federal district courts from granting habeas relief to state prisoners based on "new rules" of federal law announced after the date on which the prisoner's conviction became final:

A contrary rule [c]ould . . . create a disincentive for the Justices to recognize constitutional rights: If recognizing a new constitutional right required new trials for defendants who had originally been tried decades earlier, then the Justices would be very reluctant ever to recognize new rights.
[L]imiting money damages for constitutional violations fosters the development of constitutional law. Most obviously, the right-remedy gap in constitutional torts facilitates constitutional change by reducing the costs of innovation. The growth and development of American constitutionalism are thereby enhanced.Perhaps not surprisingly, the Supreme Court has not (to my knowledge, though I'd be happy to be corrected) offered this justification for its own doctrine. It would, after all, be awkward for the Justices to admit that they are trimming their best judgment about what the Constitution requires in order to avoid results they don't like. Indeed, in Danforth itself last week, Justice Stevens, quoting an earlier concurrence in the judgment by Justice Scalia, ringingly endorsed formalism as accounting for its own decision-making process. Justice Scalia, quoted approvingly in full by Justice Stevens, wrote:
To hold a governmental Act to be unconstitutional is not to announce that we forbid it, but that the Constitution forbids it; and when, as in this case, the constitutionality of a state statute is placed in issue, the question is not whether some decision of ours 'applies' in the way that a law applies; the question is whether the Constitution, as interpreted in that decision, invalidates the statute. Since the Constitution does not change from year to year; since it does not conform to our decisions, but our decisions are supposed to conform to it; the notion that our interpretation of the Constitution in a particular decision could take prospective form does not make sense.Sure, in some sense that's what they have to say, but of course the very existence of a body of a doctrine governing the application or non-application of "new rules" of constitutional law shows that this is at best a legal fiction.

So tell me if this is a proper layman's characterization of the Danforth matter:
1. One key question was whether the Supreme Court's retroactivity rule for federal courts was equally binding on state courts.
2. The majority said the answer to (1) is no -- states could apply precedent retroactively by virtue of their sovereignty (or something close to that) and a confusing distinction between law and remedy.
3. The dissent said the answer to (1) is yes -- otherwise, there's no real supremacy / uniformity in our system of federalism.
4. So the issue here wasn't about the way a state interprets its own constitution, leveraging SCOTUS precedent to illustrate provisions (states clearly have that right); instead, it's whether the states can add teeth *directly* to SCOTUS rulings.

I think the Supreme Court has suggested that rationale for its doctrine in a couple places. Saucier v. Katz is the first that comes to mind. Leon is another (though less clear). Double jeopardy "waiver" for reversals on appeal is another.

Thanks Ted. Saucier is a nice example, although in that case the larger concern is that the courts will never have the opportunity to develop the law if they decide QI before the merits; it's less about what the courts will do if they reach the underlying rights issue.

I don't think we need to look for explanations beyond the remedial v. choice-of-law distinction -- and Justice Stevens's opinion adequately explains why.
Suppose you think that the Supreme Court doesn't simply make new law when it decides constitutional cases, but rather explains what the Constitution has always meant. (And, if necessary, overrules prior erroneous decisions about that original meaning.) On that view, the Court's decision in Crawford establishes that every federal (and, by incorporation, state) criminal defendant has -- and has always had -- the Sixth Amendment protections described in Crawford.
For various reasons, including comity concerns, the Court has separately determined that federal courts cannot provide a remedy for violations of that right if the case announcing it was not decided until after the conviction became final. But because (as a matter of federal law) the constitutional right existed at the time of the violation, there is no reason states should be barred from granting relief for that violation.
Perhaps this isn't a great view about what the Supreme Court actually does when it decides cases; the Chief Justice's view that Teague is about choosing whether to apply old or new law is more consistent with the "modern" view that judges make rather than discover the common law. But the difference in these two positions is more than sufficient to support the result.

And as for the claim that this is empty formalism because Teague is about "new rules," the rules are "new" in the sense that the Supreme Court had not explained the proper view of the relevant constitutional provision before the conviction became final -- but that doesn't mean it was simply making the law. As Justice Stevens explained in a footnote (again quoting Justice Scalia): "The very framing of the issue that we purport to decide today -- whether our decision . . . shall 'apply' retroactively -- presupposes [an incorrect] view of our decisions as creating the law, as opposed to declaring what the law already is."

I agree with Justice Stevens and the majority on the issue of a state's ability to give broader protections in a given area, however, I feel the decision in Danforth is a dangerous proclamation that is going to open the flood gates of litigation in every post conviction department in the country. I am currently a law clerk in Pennsylvania's First Judicial District’s Post Conviction Relief Department. After reading Danforth, I will be on the lookout for a surge of pro se filings citing the Danforth ruling. As soon as the Danforth decision circulates throughout the prisons around the country the race will officially be on! State court judgments have to have an element of finality. I fear the recent Danforth decision creates a cloud over a lot of state court judgments.
